EB-5 Process

To obtain conditional permanent residency in the United States, investors must file an I-526 Petition with the USCIS. Substantial documentation evidencing that the investors funds intended for investment in the Pilot Program were derived from lawful sources is required. Such funds may be derived from real estate transactions, business income, sale of a business, employment income, or similar investments. If funds are from a gift or inheritance, additional evidence may be required. Upon approval, the investor, as well as any spouse and children under 21 will be granted conditional permanent residency status. Investors must then file a petition (Form I-829) within 24 months after receiving their conditional permanent residency, evidencing that they have successfully met all requirement of the program, including the actual creation of the required number of jobs, whether direct, indirect, or induced. Upon approval of the I-829 petition, the conditional status will be removed, and the investor will attain full Lawful Permanent Residence status.
